1. Introduction

This Privacy Policy explains how 3 Peaks Underground Construction LLC ("Company", "we", "us" or "our"), a limited liability company organized in the United States with its address at 476 Buttercup Ct, Spearfish, SD 57783-9012, United States, collects, uses, shares and protects information when you use the Pixia mobile application (package com.gen.pixia), our website and related services (together, the "Services"). Pixia is distributed on Google Play under the developer name "Rickom".

By using the Services you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Services.

2. Information We Collect

2.1 Information you provide

• Account information — such as an account identifier, nickname, avatar and, if you sign in with a third-party account (for example Google), the basic profile information and email address that the provider shares with us.
• User Content — photos, videos, selfies, templates, text prompts and other material you upload or enter to create AI videos, images or face swaps, and the content generated from them.
• Chat content — messages you send to and receive from AI characters in the app.
• Support communications — information you give us when you contact us, such as your email address and the content of your message.

2.2 Information collected automatically

• Device and app information — device model, operating system, app version, language, time zone, and device or advertising identifiers.
• Approximate location — derived from your IP address or device settings, used to provide region-appropriate content and pricing and to prevent fraud. We do not collect precise GPS location.
• Usage and diagnostic information — features used, templates selected, generation tasks, crash logs and performance data.

2.3 Purchase information

Payments are processed by Google Play. We receive purchase records (such as product, order ID, price, currency, subscription status and renewal dates) but we do not receive or store your full payment card details.

3. Photos, Faces and Generated Content

Face swap and other AI features require us to process the images you upload. We are committed to handling this data carefully:

• We process uploaded images only to provide the feature you request (for example, to generate a face-swapped video) and to keep the Services safe.
• We do not use your photos to identify you, create facial recognition templates for identification, or sell or rent your photos or facial data to anyone.
• Uploaded source files are retained only for as long as needed to provide and support the feature, after which they are deleted from our storage on a rolling basis. Generated results remain in your account until you delete them or your account.
• You must only upload images of yourself or of people who have given you permission. Do not upload images of minors.

4. How We Use Information

• To provide, operate and maintain the Services, including AI generation, face swap and AI chat features.
• To create and manage your account, process purchases, deliver in-app currency and manage subscriptions.
• To personalize content, such as recommending templates and characters.
• To display advertising, which may be based on device identifiers where permitted.
• To moderate content, detect and prevent fraud, abuse, and violations of our Terms of Service.
• To analyze usage, fix bugs and improve the Services.
• To respond to your requests and send service-related notices.
• To comply with legal obligations and enforce our rights.

5. How We Share Information

We do not sell your personal information and we do not share it with third parties for their own independent purposes. We disclose information only as follows:

• Service providers that process data on our behalf and under our instructions, such as cloud hosting and storage, AI model and computing providers, analytics, crash reporting, customer support and advertising networks. They may use the data only to provide services to us.
• Google Play to process purchases and subscriptions.
• Legal and safety — when we believe in good faith that disclosure is required by law, subpoena or court order, or is necessary to protect the rights, property or safety of our users, the public or us.
• Business transfers — in connection with a merger, acquisition, financing or sale of assets, subject to this Privacy Policy.
• With your consent — for example, when you choose to share generated content.

6. Advertising

Pixia contains ads. Advertising partners may use device advertising identifiers and similar technologies to show and measure ads. You can reset your advertising ID or opt out of personalized ads in your Android settings (Settings → Google → Ads, or Settings → Privacy → Ads, depending on your device).

7. Data Retention

We keep personal information only for as long as necessary for the purposes described in this Privacy Policy, including to provide the Services, comply with legal, tax and accounting obligations, resolve disputes and enforce our agreements. When you delete your account we delete or anonymize your personal information within a reasonable period, except where we must keep it by law.

8. Security

We use administrative, technical and physical safeguards designed to protect your information, including encryption of data in transit (HTTPS/TLS) and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Your Choices and Rights

• Access and correction — you may request a copy of, or correction to, the personal information we hold about you.
• Deletion — you can delete content in the app, delete your account in the app's settings, or email us to request deletion of your account and associated data.
• Permissions — you can withdraw camera, photo and notification permissions at any time in your device settings. Some features may not work without them.
• Marketing — you can opt out of promotional notifications in your device or app settings.

U.S. state privacy rights

Depending on your state of residence (for example California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon and others), you may have the right to know what personal information we collect, access it, correct it, delete it, obtain a portable copy, and opt out of "sale", "sharing" for cross-context behavioral advertising, or targeted advertising. We do not sell personal information. To exercise your rights, email us. We will verify your request and will not discriminate against you for exercising your rights. You may use an authorized agent, and if we deny your request you may appeal by replying to our decision.

Users outside the United States

The Services are operated from the United States. If you use them from other regions, your information will be transferred to and processed in the United States and other countries where our service providers operate. Where required by applicable law (such as the GDPR or UK GDPR), we rely on legal bases including performance of a contract, legitimate interests, consent and compliance with legal obligations, and you may have additional rights, including the right to object, restrict processing and lodge a complaint with your local data protection authority.

10. Children's Privacy

The Services are not directed to children. You must be at least 18 years old (or the age of majority in your jurisdiction) to use Pixia. We do not knowingly collect personal information from children under 13, or from anyone under 18. If you believe a child has provided us with personal information, contact us and we will delete it.

11. Third-Party Services

The Services may contain links to or integrations with third-party services, including sign-in providers and ad networks. Their handling of your information is governed by their own privacy policies, and we are not responsible for their practices.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page with a new "Last updated" date and, for material changes, give notice in the app or by other appropriate means. Continued use of the Services after changes take effect means you accept the updated policy.
